General Terms and Conditions

1.BizServant offers ist members an internet advertising service for small private and business ads, to which the following general terms and conditions apply. These general terms and conditions regulate the relationship between the advertisers, hereinafter called members, on one hand, and Volker Lassig, Schwarzwaldstr. 40c, 79189 Bad Krozingen (Germany) as the service provider, hereinafter called Administrator, on the other hand.

2. The general terms and conditions valid at the time of placing ads are applicable. Changes to the general terms and conditions are allowed at any time.

3. Anyone, 18 years or older may use BizServant, provided this occurs within the scope of these general terms and conditions.

4. At registration every member must have a valid e-mail address of his own and state his first name and last name, as well as choose his own password. In the member area the birth date and current address must be provided. The member has the option to change all the information recorded in the member area of BizServant at any time. Providing untrue information may lead to the removal of the member’s BizServant page.

5. Upon registration at BizServant and during the course of placing the first ad, the general terms and conditions are considered as accepted. The member consents at the same time to regularly receiving the BizServant newsletter with technical notifications concerning service and domain. Additionally, the member accepts receiving advertisements from his upline, that is from max. seven Upline members and no more than one per month from each Upline member. Unsubscribing from the newsletter means canceling the membership with BizServant. In this case the administrator is entitled to delete the ad as well as all established and not yet retrieved pennies and premiums of the member. The same applies if a member provides an e-mail address with auto responder or is operated by such.

6. The member can unsubscribe from BizServant at any time by deactivating the subscription in the internal member area. In this case BizServant is entitled to delete the membe’s ad, as well as all his established and not yet retrieved pennies and premiums.

7. The member may place only one free advertisement. Placing several free ads by registering multiple times using different e-mail addresses will lead to cancellation of the membership entirely and to the deletion of all ads of this member.

8. The right to place a free ad does not exist. In general, BizServant retains the right to check the ad’s contents and to decline an advertisement.

9. The following advertisement topics are not permitted at BizServant: erotica, pornography, gambling (online Casinos and similar), hacker-tools, pure cash redistribution systems, politics (neither moderate nor extreme left nor extreme right), unlawful contents and any other contents violating good morals. The advertised URL may not appear as a pop-up, pop-under and similar. In the event an ad is placed by a member containing the previously mentioned topic areas, then the Administrator is entitled to delete the advertisement. The Member may be excluded from utilizing the BizServant in the future. The Member shall not receive a special notification about deleting this advertisement.

10.To ensure BizServant’s serious image, advertisements may not contain any vulgar, defamatory remarks or words with sexual connotations or contents with the like. The Administrator is entitled to delete such advertisements. The member shall not receive any notification.

11.After placing a free ad, the Administrator shall send an e-mail to the e-mail address the member provided at the time of registration. The final release of the advertisement occurs after the member has confirmed the ad via the confirmation link received in this e-mail.

12.The regulations set forth in these general terms and conditions for advertisements are equally valid for other advertisement bookings such as buttons, banners, text-link ads and similar.

13.All correspondence and all contracts and agreements are only admissible in English.

14. The Administrator is not liable for the contents of the advertisements. Only the members are liable for the contents of their ads, especially those violating copyrights, ancillary copyrights, brands, patents, design patents, industrial property rights, the right to own image, name and personality and any other rights. BizServant is released from all third party claims resulting from ads placed by members and possible infringements through these ads.

15. The liability of the Administrator is limited to his own contents published on this domain.

16. The Administrator makes every effort to guarantee the greatest possible technical availability of the BizServant. However, the members cannot demand 100% availability. The Administrator is not liable for breakdowns and downtimes of the host server.

17. The Administrator reserves the right to change the content of the free offer at any time. This is especially valid for rebates such as pennies, premiums and similar.

The following provisions, from Point 18 to Point 27, are only valid for BS-Pro.

18. The Pro version of BizServant which is subject to a fee, hereinafter called BS-Pro, offers ist members an Internet advertising platform, the scope of which can be obtained from the service catalog published on this domain.

19. . The points 1 to 17 of the general terms and conditions in ist updated version are also applicable to BS-Pro.

20. Utilizing BS-Pro requires paying the user fee.

21. When registering at BS-Pro, the member must, in addition to providing the information listed in Point 4, also provide his date of birth and his current mailing address.

22. The daily user fee for BS-Pro is $ 0.25. The minimum utilization period is one year. The utilization period is always 365 days as of receipt of the user fee and activation of the user’s personal BS-Pro page. The utilization period shall automatically be renewed for another year, unless the subscription is terminated.

23. A right to use BS-Pro does not exist. The Administrator reserves the right to decline an order.

24. The member has the right to place any number of ads in his personal BS-Pro page (program page). If the Member violates points 7, 9 or 10 of these terms and conditions, the Administrator is entitled to request the member to delete the improper ads and to give him a grace period of 7 days for this purpose. If the member does not delete the specified ads, then the Administrator is entitled to remove the advertisement in question. The Administrator has the right to immediately remove such ads, if they contain obviously improper or unlawful contents or is at risk of default. For repeated offenses, the user may be excluded from any further use of the BS-Pro. In this case the user fee shall not be reimbursed. Existing and not yet retrieved credit memos and commissions shall also expire.

25. The use of BS-Pro may be canceled by the user with a cancellation period of 4 weeks before the end of the respective utilization period (365 days as of activation). The Administrator may terminate the membership in turn, in writing, with a cancellation period of 4 weeks before the end of the utilization period.

26. The Administrator makes every effort to guarantee the greatest possible technical availability of the BizServant. However, the members cannot demand 100% availability. The Administrator shall not assume liability for breakdowns and downtimes of the host server. Otherwise the functionality of the member’s BS-Pro pages is assured. If the Administrator can no longer provide the agreed service on a continuous basis, then this shall result in the early expiration of the agreement. In this case the user fee shall be reimbursed on a pro rata basis, calculated until the end of the possible utilization period.

27. Among the service features of BS-Pro is the option to send ads to other members of BizServant and to receive ads from them to the extent described in point 5 of these terms and conditions. The member agrees to this.

For sending notifications from BS-Pro members to the downline, sections 8, 9, 10 and 13 of these terms and conditions apply accordingly. The notifications must contain the correct site address of the sending BS-Pro member.

28. German law is the applicable law.

29. Severability clause: If provisions of these terms and conditions should become or are legally ineffective, then this shall not affect the validity of these terms and conditions as a whole. The ineffective provisions are to be replaced by effective provisions that come closest to the achievement of the pursued economic purpose.
